Looks like EA took initiative and is setting some of their new games (The Godfather and Black) at $40 price point on release day. Whether it's in response to the publicized leak of "Black" to peer-to-peer I don't know. But lower prices = drives competition and sales, so I think we all win :)
Now if only 360 games would drop :bang head
