There suing Microsoft because of the problems with Live! over the x-mas and new year period and they state in there case that MS should of known about the x-mas frenzy to buy there console. $5 Million dollors is what supposed to come upto but why is it that only 3 have decided to sue and not half a million even thou there giving away a free game to compensate it's obviosly not enough.
I don't think you understand how good the corporate lawyers for a company like Microsoft are going to be. There's already a class action lawsuit against them, so this will probably be dismissed.
3 Texans angry about the fact that their xbox live wasn't working won't mean anything. It's pretty obvious they're suing for a "breach of contract" between them and microsoft, but really when was there ever a clause in the xbox live agreement that said "this will work 100% of the time. no exceptions".
If I sued for $5M every time my internet went out, I'd be driving every color permutation of a bugatti veyron available.

Hey if I don't make a payment then they cut me off, so I guess it makes sense to sue when you make a payment and still get cut off. (Or this is America where you can sue for nothing)

Whoopie... People need to remove something from some where and think with that pea sized brain before acting. Hope its dismissed right away. Definatly not needed to be a court case expecially with the larger one going on right now.
As mentioned before I don't know any service that says theres 100% uptime. If there is well thats a huge liability.
Microsoft just might end up owning them if that ever gets to trial....

You all disappoint me.
The fact is... This isn't "some other country." This is the United States. Sure the case would never stand a chance in Athens, Greece. But what's the connection between Athens and Texas? They aren't even on the same planet. The last big thing to come out of Texas was some ego-maniacle lunk-headed dictator (I think his name was "Norm").
Here in the U.S. people sue McDonald's for less than stale french fries ("my coffee... was hot") and WIN. And they win BIG. Lawyers in other countries make some low single digit multiple of what lawyers in America make. I've had plenty of friends studying law in europe and I was even considering it myself...
But this is where the big game takes place. The most spectacular law suits and criminal trials in the history of man. (The trial of Joan of Arc wasn't even remotely as interesting as the O.J. Simpson trial... let alone The People vs. Clarence Darrow... and Joan got burned at the stake.)
Just like football isn't the same in the U.S. and elsewhere you shouldn't expect the law or lawyers to be the same either. Americans are self-righteous, puritanical, pragmatists. You should fully expect their lawsuits to reflect that. Any country where Janet Jackson showing PART of her boob could incite a national crisis is somewhere south of sane.
But, as long as we're betting, there's a 100 percent chance Microsoft settles just to get it out of the news.

I doubt they'll settle every frivolous lawsuit thrown their way or else they'll become the shysters' personal ATM. They're making ammends for it. Everything else yo wrote, pure gold my man. At least Canada is a bit more worldly, but I'll be back in TN in about a month....sigh.

Nevertheless it will be cheaper and better for Microsoft to settle out of court to avoid damage to the (already bad) reputation of the corporation.

You know about three months after I moved to Paris I was talking to one of my friends on the phone and he said there was a Pepsi commercial with Bob Dole and Britney Spears that was on T.V. ALL THE TIME.
...I knew I had made the right decision.
But as the country continued to go down the slide... I felt responsible. I *was* responsible. It's all a big web. Even if you only change one person's day, you've changed everything.

Tsk... Tsk... It's not slander if it's true. Xbox Live really WAS down. But I'm pretty sure MS already has something in their enduser agreement to cover that.

Yeah they'd become as hated as the RIAA if they did that. However if they didn't settle out of court and forced the suers to rack up TONS of lawyer fees then they'd get a feather in their cap to those of us who hate this SUE Nation (not to be confused with the honorable SOUIX Nation).
