Yeah, most manufacturers do that. Since the highest spec is 3200 they're selecting better-than-average performing 5ns chips and rating them higher. OCZ may be using only average performing 4.5ns chips to achieve the same speed.
It shouldn't matter which chips they use as long as the stick will do the speed they say it will.
