Officially, ES processors remain the property of Intel. In the past, Intel has hunted people down that "obtained" these ES CPUs and confiscated 'em. Not sure how aggresive they are nowadays. Like Extreme said, other than having the multiplier unlocked, they typically aren't that special since they tend to be very early production steppings. Now with speed step on the newer processor, you can usually drop down to the 14X multiplier which makes the ES less attractive in my opinion.
