Laptop Modem Not Working Correctly?

I have a toshiba satellite that I got from CC on black friday. The 56k onboard modem seem's to be acting kinda weird. Sometime's it connect's @ 49-52k but most of the time it connects @ 28.8K is there a way I can make it connect @ 50k ish all the time. I have done speedtest so It really is connecting @ different speed's I just would like for it to connect @ a higher speed all the time.


Any help would be great.

I think that is a function of the provider. My parents house has dialup and they never get more than 33600 even though it is a "56k" setup.
 
Blah but on my regular desktop I alway's go around 50K and as I said sometimes it show's up and I will get 49 or 50k on the lappy but most of the time it's 28.8
