after looking at the picture, i thought gainward might be using that picture, but they are not.

it's a "watermark" placed there by the site they copied the picture from, darkcrow, a korean graphics site.

Ok, here is the story about this avitar.

This logo was originally created for the original Crow movie,
but it was never used.

About 5 or 6 years ago, I happen to run into the artist who
made this logo online, and I asked if I could use it as my personal
signature/avitar/logo.

So technically, I don't own it, but I was givin permission to use
it.

For the life of me I wish I could remember the name of the
artist, so I could outright buy the logo and copyright it!!

I've already written the Korean web page and asked them
who gave them permission to use the logo, and if they
purchased it.

If they didn't purchase the logo, and they give up the name of
the artist (which I don't think they even know, I don't recall
him being asian at all), then I'll track the bloke down and
make him an official offer and make the damn thing mine
legally! LOL

Yes, I am that anal. I've been using the damn name for almost
7 years now, and the logo for about 5!!

The Internet standard on images is if it is unaltered in any way from the original... it cannot be used without permission. If it is altered at all, then it is a custom graphic and may be used. Note this does not apply to print media, merely Internet.

Now how much it is altered to warrant it being a custom graphic is left for you to decide.

(Altered doesn't mean manupulation of color, size, or scale. It means ALTERED. Grabbing someone's graphics and then running a simple filter on it doesn't make it altered.)

Stealing a LOGO is a different story all together. Worked for a company and they were in a lawsuit... this was the ruling (1999).
