Well, yes, because they own the company and can cancel the lawsuit. Moreover, they become the owners of the patents so they can do whatever they want

If you can't beat then, sue them
 
Is it even possible for Intel to buy them out at this point? Transmeta is more than just a hole-in-the-wall silicon developer and are liscencing their technology to a lot of big names. Over the last 2 years they've become quite a contender in the market, especially when it comes to power management software/hardware.
 
Besides the fact if the company doesn't want to be bought out theres no way Intel can force that unless they get majority shares or start bugging board members about it.
 
isn't patents keeping via/cyrix from selling C3 and C7 processors in the USA? patents probably explain why there are only 2 x86 processor manufactures today.

There isn't a price tag on every company. That's not exactly how Wall street works. It's more like a series of tu... wait no. It's more like the PS3. You can have one for a lot of money, but if you specifically want mine, you can't have it. I won't sell it.
